The political prosecution that was the Trump trial wasn’t so much a diabolical left-wing conspiracy as it was the natural state of institutional, altleft bias built into a legal system based on the rule of politics, rather than the rule of law. Ironically, the last time we saw this type of institutional crooked justice, it was again under the widespread cultural and political norms born of Democrats just being Democrats.
Before we return to the 1950s, let’s look at the Trump persecution.
A politically motivated prosecutor charged Trump. The legal charge is dubious, at best. The venue is crawling with biased jurors. The judge, with direct political and familial conflicts, refused to acknowledge his bias and recuse himself. He likewise saw no need to move the venue, even though several seated jurors admitted their anti-Trump bias, but nicely acknowledged they could be fair. I bet. The judge then permitted highly prejudicial, non-probative evidence to sit before the same biased jury. He used his powers on the bench to limit the defense testimony, smack down the objections, and show the jury his disdain for the Defendant. In the end, the Judge used his greatest power, instruction of the jury, to ensure a conviction, absent one courageous and unexpended juror hanging the jury.
Now, imagine it’s 1953.
A young black man is charged in an all-white jurisdiction. The white prosecutor is an active member of the KKK. He ran on segregation and law and order. His charge is a legal stretch. The Judge assigned to the case is white and a contributor to the KKK. In fact, his adult daughter is a national fundraiser for the KKK, receiving financial contributions from local democrat politicians in the jurisdiction. The jury is all white. Several Jurors admit to being KKK members, and at least one openly expresses his disdain for blacks but assures the judge he can be fair in the law and facts. After a criminal trial where the rulings all went toward the prosecution, and the judge was openly contemptuous of the Defendant and his witnesses, he instructs the jury on the law in a way that most disadvantages the defendant.
Raise your hand if you think the black man got a fair trial.
Was it an overt conspiracy? Or was it the accepted institutional culture where color was raised above reason, decency, and the law? Does it matter?
Sure, somewhere in such a jurisdiction, one man might have stood up and hung that jury. Is that the best justice for which we can hope from a system of laws?
Politics has become a religion. It’s zealotry akin to fanaticism. The idea that Juan Merchan could be fair is absurd. The notion that Trump could get a fair, unbiased jury in Manhattan, is laughable, or that the anti-Trump jurors can forego their religious faith and be fair is silly. Just weeks after his inaugural, I wrote about the War on Trump. I said it would never end. Here we are, rope in hand. The Democrats intend to lynch Trump.
Mr. Trump is at the mercy of luck. Did one brave juror slip through and will he or she be strong enough to stand against the herd to hang this jury? Or, is it more likely that it is Trump who hangs in yet another democrat lynching? To quote the modern democrat party … no justice, no peace. Where there is manifest injustice, there is nearly always revolution.
I fear the outcome of this trial. I fear the precedence as well. For once the system of justice is merely a tool of political persecution, we are nothing more than China or Russia. The only difference is that Democrats will be persecuted in Republican Jurisdictions as Republicans are persecuted in Democrat jurisdictions. Each side, of course, declaring itself to be the guardian of the people.
This won’t merely lead to additional splintering of the parties. It will split the country, and as we have seen for years, up the temperature of a brewing, asymmetrical, civil war.
If I am right that politics is the new religious fanaticism, what will be the effect of one party persecuting the other Party’s leader? Do you think we will just see letters to the editor? We are on dangerous ground. And, when lynchings happen, we damn well should be outraged.
I don’t know if this case will hand Trump, but justice in the United States is about to swing from a lamppost. Once that happens, America could see an actual insurrection.
