Judge Orders Removal of Office of Presidency From Constitution

PORTLAND, OR (Real Fake News) – Judge Michael J. McShane of the U.S. District Court in Portland, Oregon today issued an order declaring Article II of the United States Constitution to be null and void.

Article II of the Constitution established the Office of the President of the United States and the Executive Branch of the U.S. Government. As a result of Judge McShane’s order, the United States no longer has a President.

Donald Trump was elected President of the United States last year and was sworn in on January 20, 2025. Upon entry of Judge McSwane’s order today, Trump is no longer President of the United States. Vice President J.D. Vance likewise is no longer in office as his office also has been eliminated along with the entire chain of succession to the presidency given that the Office of the President no longer exists.

“As my fellow Democrat-appointed District Court judges across the country have noted, we don’t approve of the way that President Trump as a Republican was exercising his presidential powers. My colleagues chose to address their disapproval by nullifying his actions in a piecemeal manner, entering injunctions stopping each of his individual actions as president,” said McShane. “I felt that that approach was inefficient. Simply eliminating Trump’s office altogether was a far more efficient way to stop him from exercising his presidential powers in ways that we Democrat-appointed judges don’t like.”

Upon entry of Judge McSwane’s order, former President Trump immediately appealed to the Ninth Circuit Court of Appeals, but they summarily dismissed that appeal with a short one-paragraph order stating, “As Article II of the Constitution pertains to the President and Executive Branch of government, only the President or members of the Executive Branch have standing to appeal the order of the District Court. Because the Office of the President and the Executive Branch of Government no longer exist, neither Mr. Trump nor any former official of the Executive Branch have standing to appeal that order. The appeal is therefore denied.”

Mr. Trump is expected to further appeal the order to the U.S. Supreme Court.

Meanwhile, however, Senate Minority Leader Charles Schumer (D-NY) and House Minority Leader Hakeem Jeffries (D-NY) released a joint statement today announcing that now that the Office of the President has been eliminated, they are introducing legislation to remove Article III from the Constitution to eliminate the U.S. Supreme Court and the Judicial Branch.
